1. GENERAL PROVISIONS
The LA ZMRZKA CLUB loyalty system is a program operated by SERFY Czech a.s., ID: 04702735, with its registered office at náměstí Junkových 2870/3, Stodůlky, 155 00 Prague 5, registered in the Commercial Register kept by the Municipal Court in Prague, Section B, File 21279 (hereinafter referred to as the “Operator”), which is offered and intended for regular customers of LA ZMRZKA. This system allows customers to obtain unique benefits for repeated purchases in LA ZMRZKA establishments (hereinafter referred to as the “Establishments”), in particular by obtaining loyalty points for individual purchases. These collected points can then be exchanged by a member of the LA ZMRZKA club (hereinafter referred to as the “Club Member”) for products he or she chooses from the offer of the Establishment during further purchases. The benefits of the LA ZMRZKA Club are provided solely as an expression of the Operator’s free will. The Operator further reserves the right to change these benefits during the active operation of the loyalty program. The Operator reserves the right to terminate the loyalty program and inform the Club Members of this fact 1 month in advance. During this period, no further points will be credited to the LA ZMRZKA Club card.
These General Terms and Conditions of the LA ZMRZKA Club (hereinafter referred to as the "General Terms and Conditions") are the basis for the activities of the LA ZMRZKA Club (hereinafter referred to as the "Club") and determine the rights and obligations of the Club Member. These General Terms and Conditions are binding for the Operator from the date of their publication on www.lazmrzka.cz/klub, for the current Club Member from the moment when he/she expressed his/her consent to the wording of these Terms and Conditions (the implicit action of the Club Member, i.e. the use of the LA ZMRZKA Club registration after the publication of these Terms and Conditions, is also considered as consent), and for the new Club Member they are binding from the moment when he/she expressed his/her consent to them, i.e. from the date of registration to the Club.

2. MEMBERSHIP IN THE LA ZMRZKA CLUB
A member of the loyalty system can be a natural person over 16 years of age who agrees with the General Rules of the Club, if they meet the membership conditions and properly fill out the registration application. The Operator will only accept a correctly completed online registration application, which also contains the customer's consent to the processing of their personal data. Failure to provide the customer's consent to the processing of their personal data makes it impossible for the Operator to maintain a Club account for the customer. The right to membership in the Club arises by completing the registration form on the website www.lazmrzka.cz/klub/. By completing the registration form, the customer confirms his agreement to the General Terms and Conditions and Rules of the Club. A Club Member participates in the program personally and his membership is not transferable to another person. Each Club Member is entitled to only one membership. Registration in the Club is voluntary. Membership in the Club cannot be claimed and is decided solely by the Operator. The current version of the General Terms and Conditions is available at www.lazmrzka.cz/klub/.
The Operator reserves the right to refuse to accept a registration application in justified cases, in particular if it is an incomplete registration application, or if it is a registration application from a person who is already a Club Member or has been expelled from the Club, or if it is a registration application from a person under the age of 16. The LA ZMRZKA Club Card is the property of the Operator and the Club Member is not entitled to transfer it to another person.

3. LA ZMRZKA CLUB REGISTRATION
When registering for the LA ZMRZKA Club, the Club Member will receive a confirmation of the registration (hereinafter referred to as the "Confirmation"). Successful registration allows the Club Member to collect points on his/her membership account, which are awarded as bonuses for purchasing products specified by the Operator. The member can then exchange these collected points for products he/she chooses from the offer of the Establishment during further purchases. The registration is non-transferable and can only be used by the person for whom the registration was issued. Points cannot be exchanged for cash or transferred to a third party in any other way, in particular, points cannot be transferred between accounts of different Club Members and cannot be subject to any other methods of handling them than those specified in these General Terms and Conditions. The registration may only be used in accordance with the rules and General Terms and Conditions of the Club. The Operator is entitled to cancel the registration in the Club if it has been used in violation of these General Terms and Conditions or if such use has been attempted.
Each registrant should, in their own interest, immediately inform the Operator about any change in the basic data provided in the registration application. In the event that the Club Member fails to fulfill this obligation, the Operator shall not be liable for any unauthorized use of the Card, unauthorized application of a discount claim, or for any delays or deficiencies in the activity caused by the failure to timely update the Club Member's personal data. LA ZMRZKA Club registration is valid only for the duration of the Member's membership in the LA ZMRZKA Club.
If the Operator discovers that the same person holds multiple registrations for the loyalty program, LA ZMRZKA reserves the right to merge these cards, including data and benefits, into one Card and deactivate the other Cards."

4. MECHANISM FOR LOADING POINTS AND USING THE LA ZMRZKA CARD
The Operator undertakes to allocate points to the Club Member's account for products purchased under the LA ZMRZKA Club program and to register purchases made on different days at LA ZMRZKA Outlets. Points are not allocated to the Club Member for the purchase of a LA ZMRZKA gift card and this transaction is not registered on the Club Card or as a purchase made. The Operator reserves the right to determine the products whose sale falls under the LA ZMRZKA Club program. Likewise, the Operator reserves the right to determine the number of points allocated to the Club Member's account in the event of the purchase of such products. Points are allocated to the Club Member's account according to the purchase value determined in Czech crowns, with 1 point being awarded for a purchase worth 20 Czech crowns. The Operator reserves the right to change the ratio of points conversion and also to change the inclusion of products in the LA ZMRZKA Club program. In order to be awarded points, the Club Member is obliged to present his/her identification document with a photo to the Operator's employee at the Establishment before purchasing goods or using services included in the LA ZMRZKA Club program. Registration will be activated within 3 days of filling out the registration form at www.lazmrzka.cz/klub/.
Club Members receive benefits through in-kind bonuses, such that in the case of purchasing products in the Establishments, points will be credited to the Card according to the value assigned to individual products. The product point system applies to all products in the LA ZMRZKA Establishment except for the LA ZMRZKA gift card. The collected points can then be exchanged for his/her favorite product as soon as he/she has enough points in his/her account. Payment from points must be reported in advance. Points are recorded on the LA ZMRZKA Club Member's account with each paid purchase. Registration must be reported to the cash register staff before the LA ZMRZKA Club Member pays for the purchase. A Club Member who does not inform about their registration before paying or does not have a document proving their unique identification cannot earn points even when presenting a receipt. The current point balance can be checked at any time in LA ZMRZKA establishments by providing registration details and presenting an identification document to the staff. The LA ZMRZKA Club operator is not responsible for late notification of registration to the cash register staff. Registration can be used indefinitely during the day. Points on the card cannot be exchanged for cash. Points are debited by the staff when the customer requests that they exchange the points on the card for products from the offer.
The operator reserves the right to change the amount of the additional discount provided to the Club Member at any time or cancel it completely. No offers (discounts) can be added or combined, unless the Operator specifies otherwise. The Operator reserves the right to verify the identity of the Club Member when applying for a discount, by checking the Club Member's personal document by the relevant employee of the Operator. If the Club Member's identity is not credibly verified, the Operator's employee may refuse to provide the discount.
When making a product complaint, the complaint can only be made by exchanging the ordered goods, not by crediting points back to the card or returning cash."

5. TERMINATION OF MEMBERSHIP IN THE LA ZMRZKA CLUB
Membership in the LA ZMRZKA Club shall terminate:
• if the Club Member requests termination of membership;
• if the Club Member does not make any purchases within 12 months;
• if the Club Member intentionally provides incorrect information in the application;
• if the Club Member abuses the benefits resulting from membership in the Club;
• at the moment when the Club Member abuses the logo, name or other identification data of the Operator;
• at the moment when the Club Member abuses the loyalty program mechanism (primarily - crediting points to the registered account that are not covered by the Cardholder's purchase);
• at the moment of the Club Member's death;
• at the moment of termination of the club program by decision of the Club Operator without giving a reason;
• for other serious reasons.
By canceling the Club membership, the registration is automatically blocked. In the event of cancellation of Club membership, the procedure will be in accordance with Act No. 101/2000 Coll., on the protection of personal data, and the personal data of the Club member will be irretrievably destroyed from the Club database.

6. TERMINATION OF THE LA ZMRZKA CLUB
The Operator reserves the right to suspend or terminate the activities of the LA ZMRZKA Club at any time. In the event of suspension or termination of the activities of the LA ZMRZKA Club, the Operator is obliged to inform about the suspension or termination of the activities at the LA ZMRZKA Establishments and at www.lazmrzka.cz/klub/. If the activities of the LA ZMRZKA Club are terminated, the Club Member, if he has collected the appropriate number of points according to these General Terms and Conditions, is entitled to exchange the points thus collected for products, no later than one month from the notification of the cancellation of the LA ZMRZKA Club. In other cases, all points on the member accounts will be deducted. The right to a discount is not enforceable by the Club Member in court.

7. CHANGES TO THE GENERAL TERMS AND CONDITIONS
The Operator reserves the right to change these General Terms and Conditions at any time. A change to the General Terms and Conditions is valid from the date of their publication on www.lazmrzka.cz/klub/. Use of the Club Card by the Club Member after the publication of a change to the Terms and Conditions is considered consent to such change. If the General Terms and Conditions are changed, their new and complete text must be available on www.lazmrzka.cz/klub/.

8. PROTECTION OF PERSONAL DATA
By completing the registration application, the Customer expressly agrees that the Operator will process his personal data specified in the registration form on www.lazmrzka.cz/klub/ as well as other data provided to the Operator during business relations, in particular in connection with his participation in the LA ZMRZKA Club. This consent is granted for an indefinite period of time, or until the written withdrawal of this consent, or until the termination of the LA ZMRZKA Club. The customer acknowledges that he may withdraw his consent at any time in writing.
The operator, as the administrator, is obliged to process the customer's personal data in accordance with Act No. 101/2000 Coll., on the protection of personal data, as amended. The customer hereby acknowledges that the operator hereby informs him and agrees that his personal data will be processed for the purpose of managing his account in the LA ZMRZKA Club or for the purpose of other marketing activities. The club member agrees that the operator will send him up-to-date information about commercial or promotional events organized by the operator in LA ZMRZKA establishments by phone, text message or email, if he has given his consent to this when joining the LA ZMRZKA Club or at any time during the duration of his membership in the Club.

9. AGREEMENT WITH THE GENERAL TERMS AND CONDITIONS
A LA ZMRZKA Club member expresses his/her agreement with these General Terms and Conditions by sending the registration application. LA ZMRZKA Club General Terms and Conditions valid as of 1.1.2022.
